Delivery Policy

This Delivery Condition (“Terms”) governs the Delivery of LFi Hardware Products, included but not limited to: LFi Smartphone, XLFi Machine (1000 and 5000) (“Hardware”), from Lyotech Labs (“Supplier”) to individuals/businesses purchasing the Hardware (“Purchaser”) sold on lyotechlabs.com (“Platform”).

1. General Provisions

The Supplier's General Terms and Conditions shall apply in conjunction with these Terms, along with the Privacy and Cookie Policy which are incorporated by reference, along with all other Terms, Policies and Agreements you have agreed to in purchasing the Hardware.

2. Shipping Method

2.1. Our courier partner is UPS Gulf LLC (Dubai Branch), 25th Floor, Al Moosa Tower 2, Sheikh Zayed road, Dubai, UAE (“Courier”). The Courier will provide the Delivery Service for the fulfillment of your purchase and is able to ship to the physical address within the given locations upon checkout.
2.2. Purchaser is aware our courier partner may vary based on delivery location.
2.3. Supplier shall update Purchaser upon dispatch of their Hardware.

3. Process of Shipping and Delivery Fees

3.1. Purchases of any Hardware are delivered by courier only, there is no alternate method of receiving the Hardware. Therefore, all such purchases are subject to transportation fees (“Delivery Fees”).
3.2. Deliveries can be expected within ninety (90) working days (Monday-Friday), from the day the user paid for the shipping.
3.3. Delivery Fees
3.3.1. Delivery Fees are subject to variation based on the location you are receiving your order to;
3.3.2. The applicable Delivery Fees will be calculated automatically upon checkout when you purchase on the Platform based on your location; and
3.3.3. Delivery Fees are solely borne by the Purchaser.
3.3.4. The multiple shipments may lead to multiple charges appearing on the monthly statement of the Purchaser. The charges can be found during the checkout process.
3.4. Shipping and delivery details:
3.4.1. For Purchaser purchasing from the USA, shipping will be managed by LYOTECH LABS LLC 8 The Green, Suite Rin the Cityof Dover, Zip code - 19901
3.4.2. For Purchaser purchasing from EU, shipping will be managed by LYOTECH LABS LIMITED 33 NEWMAN STREET 2ND FLOORLONDON ENGLAND W1T 1PYCompany Number 14694218;
3.4.3. For Purchaser purchasing from MENA, shipping will be managed by LYOTECH LABS LLC WHP2-BLOCK-T COMMERCIAL Area: Saih Shuaib 3, Dubai, UAE;
3.4.4. For Purchaser purchasing from any other country, shipping will be managed by LYOTECH LABS Limited Room 1104, Crawford House, 70 Queen's Rd. Centra, Central, Hong Kong.
3.5. We strictly adhere to the Laws of the United Arab Emirates and Hong Kong, and do not engage in any transactions and/or offer products and services to any individuals, organizations, groups, and/or countries which have established and/or possible connections to sanctions imposed by Office of Foreign Assets Control (OFAC), European Union (EU), United Nations Security Council (UN), and UAE Local Lists (including but not limited to sanctions lists and terrorist lists).
3.6. This list is subject to change at the sole discretion of the Supplier, for any reason including but not limited to internal policy decisions, Courier’s policies, and international sanctions or restrictions.
3.7. Purchaser acknowledges and accepts that we do not issue refunds for Hardware, if between the time of purchase and dispatch the list provided in clause 3.2 has been subject to change, we will not be liable for any loss or damages endured.

4. Receiving Hardware

The Purchaser shall not refuse to receive Hardware. If they do so in breach of these Terms, they will not be applicable to receive the Hardware or a refund.
Delivery shall be between 9 am to 6 pm GST, Monday to Friday, subject to any unforeseen delays or public holidays, for which the Supplier shall not be held responsible.

5. Notifications of Delivery

5.1. Should it be permitted by the selected Courier delivering to your destination, you may receive regular updates of your order status through the given Courier’s tracking services.
5.2. Supplier will confirm your order via email upon receiving the payment, upon which you can expect the Hardware purchased to be dispatched within 90 working days.

6. Change Order

6.1. Once you have made your purchase, you may be unable to change the provided delivery details. 6.2. If you wish to change your delivery details, you can contact our Customer Services at: [email], and if it is before dispatch they may be able to assist in the delivery details change.
6.3. Should a change in details not be possible for your order, the Purchaser will bear any additional costs to have the goods delivered to a different location if applicable, and will not receive a refund for the previous Delivery Fees.

7. Delivery Information

7.1. The Hardware purchased will be delivered to the delivery address specified in your order. Please ensure that you provide the correct delivery details and contact information to ensure there is no delay in the delivery due to misinformation.
7.2. The Supplier reserves the right to charge you additional fees for a delivery attempt, missed shipment or for the shipping return of rejected goods or any other fees incurred due to incorrect delivery information or receipt of the Hardware.

8. Customs, Duties and Taxes

Prices at checkout do not include all customs, duties and taxes. Any additional fees outside of those included will be charged directly to the Purchaser. Should these additional fees not be paid and the Hardware returned to the Supplier, the Supplier shall not be responsible for issuing a refund and Purchaser will be required to pay the consequential Delivery Fees and any additional fees required for re-shipment.

9. Payment Confirmation

Upon receipt of payment, an invoice will be generated and promptly sent to the Purchaser via the registered email address or via SMS. It is the Purchaser’s responsibility to provide an updated email address or phone number to receive the payment confirmation.

10. Packaging

10.1. Supplier shall properly prepare, secure and package the Hardware in a manner suitable for shipment to provide adequate protection against damage in transit.
10.2. Should damages in transit occur to the Hardware, the Supplier will not be responsible.

11. Warranty

11.1. All Hardware include standard warranty for one year (the Warranty Period) provided by the manufacturer of the Hardware(s) (Manufacturer).
11.2. Standard warranty is provided by third party manufacturers, not the Supplier. Supplier bears no responsibility for the manufacturer’s warranty, and Purchasers are advised to read the terms of such warranty carefully before purchasing.
11.3. Purchasers may purchase additional warranty packages for their Hardware, including either the One Care Plan for the LFi Smartphone or the XLFi Machine Care Policy for the XLFi Miners (1,000, 5,000, 10,000 and validator) (Additional Warranty Plans).
11.4. Additional Warranty Plans are valid for one year and subject to their own Terms and Conditions which you are solely responsible for reading and agreeing to when purchasing.
11.5. The coverage of your Hardware depends on the package you have purchased, damage caused by shipping will be covered to the extent as provided in the terms of these individual plans.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPPLIER AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER OF THE HARDWARE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM SUPPLIER’ OBLIGATIONS UNDER THIS DELIVERY CONDITION. SUPPLIER SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPLACE THE HARDWARE DUE TO ANY DAMAGE CAUSED IN DELIVERY, (ii) IT WILL DELIVERY THE HARDWARE BY A SPECIFIC TIME, OR (iii) THE DELIVERY OF THE HARDWARE WILL BE UNINTERRUPTED AND DELIVERED WITH NO ERROR. THE BENEFITS CONFERRED BY THESE TERMS ARE IN ADDITION TO ANY RIGHTS AND REMEDIES PROVIDED UNDER CONSUMER LAWS AND REGULATIONS. TO THE EXTENT THAT LIABILITY UNDER SUCH LAWS AND REGULATIONS MAY BE LIMITED.

13. Force Majeure

Supplier shall bear no liability under or be deemed to be in breach of these Terms for any delays or failures in performance of these Terms which result from Force Majeure. The party subject to the Force Majeure event shall promptly notify the other party in writing when such the event causes a delay or failure in performance and when it ceases to do so.

It is important to understand and adhere to these terms before initiating a return or refund for any product.

15. Product Availability

15.1. The Supplier shall make reasonable efforts to supply all Products ordered in conformity with this agreement. The Supplier does not, however, guarantee the availability of any Products.
15.2. If shortages of any ordered Products arise for any reason, the Supplier shall inform the Purchaser via email of the resolution for such occurrence.

16. Delivery Delays

16.1. Supplier will not be liable for any loss of damages resulting from late delivery.
16.2. All delivery time estimations given by the Supplier are indications only, and do not constitute any guarantees or promises for completion of delivery within these times.
16.3. Upon dispatch of the Hardware, all delivery responsibility shall vest with the Courier.

17. Missing/Damaged Orders

If you do not receive your order, or your order is damaged in transit, please contact our Customer Support at the Details provided in clause 17 for assistance with your matter.

19. Applicable Law and Dispute Resolution

These Terms and their interpretation shall be governed by the laws of Dubai, United Arab Emirates. For any disputes that cannot be amicably resolved, the courts of Dubai, United Arab Emirates shall have the exclusive jurisdiction to resolve the dispute.
